PRIVACY & DATA POLICY

1. Privacy.
Ed & Joe’ s will not sell, rent or give away your private data. You, as customer (the “Customer”) may receive e-mail or physical mail communications from Ed & Joe’ s for the use of marketing, or special communications. Ed & Joe’s takes Customer’s right to privacy seriously and wants you to feel comfortable using this web site. This privacy policy deals with personally-identifiable information (referred to as “Data” below) that may be collected by this site. This policy does not apply to other entities that are not owned or controlled by Ed & Joe’s, nor does it apply to persons that are not employees or agents of the site editor, or that are not under the site editor’s control.

2. Collection of Data.
Registration for an account on this site requires a unique and valid e-mail address through which you can receive communications from Ed & Joe’ s. Customer is not required to provide any other information if you do not want to. Please be aware that the e-mail address you provide and any other information you enter may render you personally identifiable and may possibly be displayed on this web site unintentionally (subsequent to a successful act of intrusion by a third party). As on many web sites, Ed & Joe’s may also automatically receive general information that is contained in server log files, such as Customer’s IP address, and cookie information. Information about how advertising may be served on this site (if it is indeed Ed & Joe ‘ s policy to display advertising) is set forth below.

3. Payment.

a) Credit Card Payment. Customer agrees that payment may only be made by
authorized credit card or debit card payment. The following are authorized credit cards: Visa, Mastercard, Discover and American Express. Customer’s credit card or debit card will be charged on the date that the services are provided but prior to commencement of the services. If Customer elects to purchase services through Ed & Joe’s Site, Customer agrees to pay the amount presented on the confirmation screen.

b) No Refunds. No refunds will be issued once the food and related services have been completed, for any reason.

4. Promotional Codes.
From time to time and at Ed & Joe’s sole discretion, Promotional Codes made be issued on such terms and conditions as Ed & Joe’s determines in its sole discretion. Promotional Codes must be entered and redeemed at the time Customer books services and not thereafter.

5. User Conduct.
Customer agrees with each of the following in connection with Customer’s use of the Site:

• • To comply with all applicable federal, state and local laws and regulations regarding online conduct;
  • Not to submit payment through the Site if you are under the age of 16;
  • Not to submit payment through the Site using a third-party’s credit or debit card without the express consent of the credit or debit card owner;
  • Not to use the Site for illegal purposes;
  • Not to commit any acts of infringement on the Site or with respect to content on the Site; Not to copy any content, for republication in print or online;
  • Not to interfere with another person’s use and enjoyment of the Site;
  • Not to upload or transmit viruses or other harmful, disruptive, or destructive files; and/or Not to disrupt, interfere with, or otherwise harm or violate the security of the Site, system resources, accounts, passwords, servers, or networks connected to or accessible through the Site or affiliated or linked sites.

6. Proprietary Rights.
Customer acknowledges and agrees that the Site contains proprietary information and content that is protected by intellectual property and other laws, and may not be used except as provided in these Terms of Use and Services without advance, written permission of Ed & Joe’s. All designs, text, graphics, interfaces, and images (and the selection and arrangements thereof), and software, hypertext markup language (“HTML”), scripts, active server pages, and other content and software used in the Site are reserved and are the sole property of Ed & Joe’s.

7. Disclaimer As To Website Content.
Ed & Joe’s will use reasonable efforts to provide accurate content on the Site free from viruses and infections. However, Customer by use of the Site and downloading from the Site, does so at Customer’s sole risk and Ed & Joe’s shall not be responsible in whole or in part for any loss of data or other damages to Customer’s computer caused by viruses, infections or other causes.

8. Limit of Liability.
The entire liability of Ed & Joe’s services shall be limited to the invoice amount for the food and services provided. Further, Ed & Joe’s shall incur no liability for failure or interruption of services resulting for acts beyond the reasonable control of Ed & Joe’s including weather related circumstances.

9. Dispute Resolution.
Customer agrees that resolution of any disputes arising hereunder shall be brought in the Circuit Court of Cook County, Fifth Municipal District, which the parties agree shall have exclusive jurisdiction and venue regarding any such disputes. CUSTOMER AGREES TO WAIVE ANY RIGHTS TO A TRIAL BY JURY.
